Abstract
The main objective of the Masters thesis was to examine the use of comparison criteria of the economically most advantageous tender when tendering adaptation work projects in context of land consolidation. The adaptation works include field main drains, piping, subsurface drains, regional roads required by the appropriate real estate structure, and other roads necessary for land consolidation. The real estate units involved in land consolidation constitute a procurement division defined by the Act on Public Contracts (348/2007) as it receives state aid for more than half of the contract value. According to the first clause of the Act on Public Contracts all the entities must tender their purchases in accordance with the regulations of the Act. According to the Act on Public Contracts the awarded contract may be either the economically most advantageous tender from the point of view of the contracting authority or the lowest price. When the economically most advantageous tender is selected as the award criteria, the comparison criteria and their relative weighting must be indicated in the procurement notice or in the tender documents. In contracts exceeding the national threshold value the comparison criteria must be informed at least in the order of importance. In the study several people were interviewed in local surveying offices, excavation work companies and other public entities. Based on the interviews conducted in the local surveying offices a need for further training was found concerning the tendering practices of the current adaptation work projects. The need for training was related, in particular, to the comparison criteria of the economically most advantageous tender and the eligibility criteria set for the bidders. Based on the interviews and the literature study condensed directions were prepared for the author of invitation to tender to evaluate bidders' eligibility, to evaluate the compliance of the bid with the invitation to tender and to compare the bids. The study resulted in drafting a model template for scoring, comparison criteria and the eligibility assessment of the bidders for the use of local surveying offices. At the end of the study general recommendations are also provided for the authors of invitation to tenders. The recommendations cover e.g. the eligibility evaluation of the bidders, characteristics of the comparison criteria, appliance of the Act on the Contractor's Obligations and Liability when Work is Contracted Out and small purchases falling below the threshold value.Diplomityön keskeinen tavoite oli tarkastella kokonaistaloudellisen edullisuuden vertailuperusteiden käyttöä tilusjärjestelyjen yhteydessä tehtävien mukauttamistoimenpidehankkeiden kilpailuttamisessa. Mukauttamistoimenpiteitä ovat peltojen valtaojitukset, putkitukset, mukauttamissalaojitukset, tarkoituksenmukaisen kiinteistörakenteen vaatimat alueelliset tiet sekä muut tiet, joiden tekeminen on toimituksen yhteydessä tarpeellista. Tilusjärjestelyjen jakokunta on hankintalaissa (348/2007) tarkoitettu hankintayksikkö, koska se saa valtion tukea yli puolet hankinnan arvosta. Hankintalain 1 §:n mukaan kaikkien hankintayksiköiden on kilpailutettava hankintansa hankintalain säädösten mukaisesti. Hankintalain mukaan tarjousten valintaperusteena voi olla kokonaistaloudellinen edullisuus tai halvin hinta. Kokonaistaloudellisen edullisuuden ollessa valintaperusteena vertailuperusteet ja niiden suhteellinen painotus on ilmoitettava hankintailmoituksessa tai tarjouspyyntöasiakirjoissa. Kansallisen kynnysarvon ylittävissä hankinnoissa vertailuperusteet on ilmoitettava ainakin tärkeysjärjestyksessä. Työssä haastateltiin useita henkilöitä maanmittaustoimistoissa, maanrakennusyrityksissä ja muilla julkisilla tahoilla. Maanmittaustoimistoissa tehtyjen haastattelujen perusteella oli havaittavissa tarvetta koulutukselle mukauttamistoimenpidehankkeiden kilpailuttamisessa. Koulutustarve koski erityisesti tarjouspyynnöissä ilmoitettujen tarjouksien valinta- ja vertailuperusteita sekä tarjoajien kelpoisuusehtojen asettamista. Haastattelujen ja kirjallisuustutkimuksen pohjalta laadittiin tiivistetty ohjeistus tarjouspyyntöjen laatijalle tarjoajien kelpoisuuden arviointiin, tarjouksen tarjouspyynnön mukaisuuden arviointiin ja tarjousten vertailuun. Työn tuloksena saatiin laadituksi malli- pohja pisteytyksestä ja vertailukriteeristöstä sekä tarjoajien kelpoisuuden arvioinnista maanmittaustoimistojen käyttöön. Työn lopussa esitetään myös yleisiä suosituksia tarjouspyyntöjen laatijoille. Suositukset käsittelevät mm. tarjoajien kelpoisuuden arviointia, vertailuperusteiden ominaisuuksia, tilaajavastuulain (1233/2006) soveltamista ja pieniä kynnysarvon alittavia hankintoja.Description
