Abstract

This thesis studies two decision problems of intellectual property rights (IPR) management. The problems, supported by case examples, consider valuation and commercialisation of a single IPR-protected invention and the management of several standards-related IPR assets. The analysed problems are approached with the methods of dynamic optimisation and system dynamics, respectively. The thesis consists of two articles and an introductory part. In the first paper, we develop a patent valuation method based on the real option theory and dynamic programming. In this method, market uncertainties related to the patent are modelled through a trinomial lattice which accommodates for the value of exploiting the abandonment real option during the lifetime of the patent. Additionally, the method yields the optimal exercise levels for the real option, against which the actual realisations of the key uncertain variable can be compared in the future. Thus, in addition to the numerical value estimate for the patent, the method gives qualitative check points for the decision maker to follow during the course of the patenting project for the possible exercising of the included real option. The second paper studies the development of standards-related intellectual property and the income from technology licensing. We develop a system dynamics simulation model for technology and product markets and identify the Nash equilibrium strategies for the companies that develop the IPR-protected standards and the companies that utilise those standards in their products. The model allows the decision makers in the licensor and licensee companies to identify' royalty levels for IPR that provide both an incentive to innovate and an incentive to commercialise the technology-based innovations.

Tässä työssä tarkastellaan kahta immateriaalioikeuksien (intellectual property rights, IPR) hallintaan liittyvää päätöksenteko-ongelmaa. Näissä todellisiin tapausesimerkkeihin perustuvissa ongelmissa tutkitaan yksittäisen IPR-suojatun keksinnön arvottamista ja kaupallistamista sekä teknologiastandardiin liittyvän IPR-salkun hallintaa. Päätöksenteko-ongelmia tarkastellaan dynaamisen optimoinnin ja systeemidynamisen mallintamisen avulla. Työ koostuu kahdesta erillisestä artikkelista sekä johdanto-osasta. Ensimmäisessä artikkelissa kehitetään reaalioptioteoriaan ja dynaamiseen optimointiin perustuva viitekehys patenttien arvottamiseen, Lähestymistavassa patentin tuleviin markkinoihin liittyvät epävarmuudet mallinnetaan trinomihilan avulla, joka mahdollistaa patentin hylkäysreaalioption huomioinnin arvottamisessa patentin elinkaaren aikana. Lisäksi menetelmän avulla saadaan reaalioptioille optimaaliset toteutustasot, joihin keskeisten markkinaepävarmuuksien realisaatioita voidaan tulevaisuudessa verrata. Menetelmä antaa siten päätöksentekijälle numeerisen arvoestimaatin lisäksi seurattavat kvalitatiiviset tarkastuspisteet patentointiprojektin elinkaaren ajaksi sen mahdollista hylkäämistä varten. Toinen artikkeli tarkastelee teknologiastandardeihin liittyvien immateriaalioikeuksien kehittämistä ja lisensoinnista saatavia korvauksia. Artikkelissa kehitetään systeemidynaaminen simulointimalli teknologia- ja tuotemarkkinoista ja tunnistetaan Nash-tasapainostrategiat sekä IPR-suojattuja standardeja kehittäville yrityksille että yrityksille, jotka hyödyntävät näitä standardeja tuotteissaan. Mallin avulla sekä lisenssin antajien että lisenssin saajien on mahdollista löytää rojaltitasot, jotka kannustavat sekä teknologian kehittämiseen että kaupallistamiseen.
