Abstract

The water areas in Finland may be divided into state owned public water areas and private water areas. The private water areas are owned either privately or jointly. Jointly owned water area is a cadastral unit belonging to two or several real properties according to certain share of ownership. In January 2004 there were slightly more than 20.000 jointly owned water areas in the cadastre. In many of the reports prepared by the Finnish Game and Fisheries Research Institute the small size and the fragmentation of water areas are hindrances to their use and maintenance. The distribution of water areas into cadastral units is outlined in the study. The joint property management associations of the water areas in the province of South Savo were classified on the grounds of their size and the amount of participating property units in order to discover the most fragmented municipalities. The study describes the progress of managing the jointly owned water areas and the consolidation procedure of the water areas with a functional diagram and examples. The factors influencing the consolidation decision are formed on the grounds of general theories and circumstances occurring at the proceedings. The study outlines the factors contributing to the consolidation of the joint property management associations formed by partners in the jointly owned water areas, and the factors preventing the consolidation. The research material consists of the 73 consolidations implemented in Finland in 1999 to 2003, the 280 joint property management associations, and the 37 000 participating property units involved. The factors preventing consolidation were also studied considering 50 joint property management associations with a negative decision. Factors contributing to consolidation are previous co-operation among the joint property management associations and their degree of organisation. It will become more difficult when 1 to 4 partners have two thirds of the shares minimum, or the area per partner exceeds six hectares. The problems with consolidation are the launching of the project among unorganised joint property management associations, the multi-phase proceedings with potential to various appealing and rectification, and the high price of the procedure. The problems will decrease when the cadastral survey procedure is developed and co-operation is increased.

Suomen vesialueet voidaan jakaa valtion omistamiin yleisiin (public) vesialueisiin ja yksityisiin vesialueisiin. Yksityisomistuksen piiriin kuuluvat vesialueet ovat joko kiinteistöjen vesialueita tai yhteisiä (jointly owned) vesialueita. Yhteisellä vesialueella tarkoitetaan kiinteistörekisteriin merkittyä yksikköä, joka kuuluu kahteen tai useampaan kiinteistöön tietyn perusteen mukaisin osuuksin. Vuoden 2004 tammikuussa kiinteistörekisterissä oli hieman yli 20.000 yhteistä vesialueyksikköä. Useissa riista- ja kalatalouden tutkimuslaitoksen "Kalaveden omistajan profiili" -raporteissa on vesialueiden pieni koko ja pirstaleisuus todettu niiden käyttöä ja hoitoa vaikeuttaviksi seikoiksi. Tutkimuksessa selvitettiin vesialueiden jakaantuminen kiinteistörekisterin mukaisiin yksiköihin. Etelä-Savon vesialueiden osakaskunnat luokiteltiin niiden koon ja osakaskiinteistömäärän perusteella eniten pirstoutuneiden kuntien selvittämiseksi. Tutkimuksessa on kuvattu yhteisten vesialueiden hallinnon kehittymistä, vesialueiden yhdistämismenettelyä toimintakaavion ja esimerkkien avulla. Yhdistämispäätökseen vaikuttavat tutkittavat tekijät on muodostettu yleisten teorioiden sekä toimituksissa esiin tulleiden seikkojen perusteella. Tutkimuksessa selvitettiin, mitkä tekijät edistävät yhteisten vesialueiden osakkaiden muodostamien osakaskuntien yhdistämisiä ja mitkä tekijät ovat esteenä yhdistämisille. Tutkimusaineistona ovat olleet kaikki Suomessa 1999-2003 suoritetut 73 yhdistämistapausta, niissä mukana olleet 280 osakaskuntaa ja 37 000 osakaskiinteistöä. Yhdistämisiä estäviä tekijöitä tutkittiin myös 50 kielteisen päätöksen tehneestä osakaskunnasta. Yhdistämisiä edistävät osakaskuntien aikaisempi yhteistoiminta ja osakaskuntien järjestäytyneisyys. Ne vaikeutuvat, kun 1-4 osakkaalla on vähintään kaksi kolmannesta osuuksista tai osakaskohtainen pinta-ala nousee yli kuuden hehtaarin. Yhdistämisten pulmakohtia ovat hankkeen käynnistäminen järjestäytymättömien osakaskuntien osalta, monivaiheinen menettely erilaisine muutoksenhaku- ja oikaisumahdollisuuksineen sekä yhdistämistoimitusten kalleus. Ongelmat vähenevät, kun toimitusmenettelyä kehitetään ja lisätään yhteistoimintaa osakaskuntien sekä eri hallinnonalojen välillä.
